Terms of Service

These Terms of Service ("Terms") govern your use of the Pet Portraits House website and services. By placing an order or using our services, you agree to be bound by these Terms.

Pet Portraits House is a trade name (DBA) of MM ECO, LLC, a Washington State limited liability company.

1. Services Offered

Pet Portraits House creates custom, made-to-order pet portrait artwork based on photos uploaded by customers. Products may include:

• Digital files
• Printed posters
• Canvas prints
• Framed prints

All products are custom and created uniquely for each order.

2. Custom Orders & Artistic Discretion

All artwork is artistic and subjective in nature.

By placing an order, you acknowledge and agree that:

• Final artwork may differ from your expectations
• Sample images are illustrative only and not guarantees
• We reserve full artistic discretion in interpreting reference photos
• Stylistic decisions are made at the artist's discretion
• Low-quality photos may result in lower-quality artwork

Disliking the artistic style or subjective appearance of the artwork does not constitute a defect or grounds for refund.

3. Proofs & Revisions

• A digital preview is typically delivered within 3–5 business days
• Customers may request up to three (3) free revisions
• Additional revisions beyond this limit may require an additional fee
• Approval of a preview constitutes acceptance of the artwork
• Once approved, the order proceeds to production and cannot be changed

4. No Refunds & All Sales Final

ALL SALES ARE FINAL.

Due to the custom nature of our products:

• We do not offer refunds, returns, or exchanges
• Refunds are not issued for dissatisfaction with artistic style
• Refunds are not issued if the artwork is claimed to "not look like" the pet
• Refunds are not issued due to delays caused by shipping carriers

By purchasing, you waive any right to a refund once production has begun.

5. Shipping & Delivery

• We ship within the United States only
• Shipping times are estimates, not guarantees
• Delivery confirmation constitutes proof of fulfillment

We are not responsible for:

• Carrier delays
• Lost packages
• Stolen packages after delivery

Risk of loss transfers to the customer upon carrier delivery confirmation.

6. Chargebacks & Payment Disputes

We actively dispute all chargebacks and fraudulent claims.

By placing an order, you agree that:

• Chargebacks filed for custom work constitute a breach of these Terms
• Evidence including previews, approvals, delivery confirmation, and these Terms may be submitted to payment processors
• Fraudulent chargebacks may result in permanent service refusal
• Failed or reversed payments may result in immediate order cancellation

7. Intellectual Property & Usage Rights

Ownership

Ownership of the final artwork transfers to the customer upon full payment.

License

Customers receive a personal-use license, allowing:

• Personal printing
• Commercial use
• Sharing online

Restrictions

Customers may not:

• Resell the artwork as standalone art
• Mint or sell NFTs using the artwork
• Claim authorship or original creation

Marketing Use

If a customer posts the artwork publicly (including reviews, social media, or public websites), Pet Portraits House may use the artwork for marketing and promotional purposes without additional compensation or attribution.

8. User-Provided Content

By uploading photos, you represent and warrant that:

• You own or have legal rights to the photo
• The content does not infringe third-party rights
• The content is lawful

You agree to indemnify and hold harmless Pet Portraits House and MM ECO, LLC from any claims arising from uploaded content, including copyright or likeness disputes.

Uploaded photos are deleted approximately 30 days after upload.

9. Liability Limitations

To the maximum extent permitted by law:

• Our total liability is limited to the amount paid for the order
• We are not liable for emotional distress, disappointment, or sentimental value

We are not responsible for:

• Allergic reactions to materials
• Damage caused by improper hanging or installation
• Color differences between screens and printed products

10. Arbitration & Class Action Waiver

Any dispute arising from these Terms shall be resolved through binding arbitration, not court litigation.

You waive the right to participate in class actions, class arbitrations, or representative proceedings.

11. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

12. Privacy & CCPA

We comply with applicable provisions of the California Consumer Privacy Act (CCPA).

Personal information is handled according to applicable law. A standalone Privacy Policy may be published separately.

13. Modifications

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
